Franchise Litigation

Our lawyers have successfully represented both franchisors and franchisees in this ever-changing area of law. With the enactment of the Arthur Wishart Act and the now statutory duty of good faith imposed in franchise relationships, Canadian franchises are governed by even more regulation more akin to public corporate vehicles, in addition to having to meet normal business requirements. Labour & Employment

Chitiz Pathak has acted for employers and employees in a variety of matters. With respect to the litigation of wrongful termination and other employment-related cases, Ontario has enacted complex legislation to govern the employment relationship. Our lawyers are well versed in the provisions of the Employment Standards Act, the Pay Equity Act and the Human Rights Code as well as other legislation reflecting employer/employee relationships.

Wrongful termination claims and other newly developed causes of action arising out of the employment relationship continue to challenge employers. We represent both employees and employers with respect to charges, investigations and complaints before the provincial trial and appellate courts as well as before numerous governmental agencies including the Ontario Human Rights Commission. Our lawyers are familiar with factual and legal defences to wrongful dismissal litigation and have been able to assist a departing employee in negotiating a termination package on the best possible terms and without litigation.

We help employers design voluntary early retirement packages and provide advice regarding layoffs that reduce the risks of litigation. Where employers seek termination for just cause, we assist in documenting concerns in a fair and effective manner. Where termination is for other reasons we have ably negotiated and created cost effective settlements. We also protect our clients' business property, confidential information and customer bases by drafting and enforcing non-competition, non-disclosure and non-solicitation agreements.
